1. Agreement and Acceptance of Trade

 

Please read these Terms carefully as they contain important information, including information on warranties and limitations of liability. By placing an order through the Website, you acknowledge that you have read these Terms of Trade.

 

These Terms of Trade apply to you, an individual who is not acting as a commercial entity, for the purchase of the Products on this Website.

 

You are responsible for making all arrangements necessary for you to have access to our Website. You are also responsible for ensuring that all persons who access our Website through your internet connection are aware of these terms, and that they comply with them.

 

2. Amendments and Updates

 

Access to our Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Website without notice. We will not be liable if, for any reason, our Website is unavailable at any time or for any period.

 

We reserve the right to update these Terms from time to time. It is your responsibility to check for such changes. If you do not wish to accept the new Terms, you should not continue to use the Website. If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms. We also reserve the right to modify or withdraw, temporarily or permanently, this Website and the material contained within (or any part) without notice to you and you confirm that we shall not be liable to you for any modification to or withdrawal of the Website or its contents.


 

3. Definitions and Application

 

In these Terms, "LOW-KEY" means LOW-KEY UK Ltd, trading as LOW-KEY, "you" and “your” means you, the individual who is ordering the Products, the "Products" means the LOW-KEY Products which may be ordered on the Website and “Website” means www.low-key.co.uk

 

The Website is managed within the United Kingdom, and we make no representation that any content is appropriate or available for use at any other location outside the United Kingdom. If you access the Website from a location outside the United Kingdom, you are responsible for compliance with all local laws.

 

The online sale of the Products offered on the Website is intended only to individuals who are residing within the United Kingdom (mainland) and for delivery within this geographic area only.

 

4. Order Placement, Pricing & Delivery

a. Products

 

The Products covered by these Terms of Trade are those presented on this Website, subject to availability.

 

LOW-KEY will use its best efforts to ensure that any photograph of any of the Products presented on the Website is as accurate as possible. Please note, however, that the representation of the Products as produced by your computer screen may differ from the exact Product.

 

b. Shipping costs and deliveries

 

We aim to deliver Products to you at the place of delivery requested by you within the time indicated by us at the time of your order, but we can’t guarantee firm delivery dates or time, as such delivery estimate information is indicative only. LOW-KEY reserves the right to change or cancel the cost of delivery – inclusive of complimentary services, for example, free shipping.

 

c. Orders

 

To submit an order for Products:

 

You need an email address to place an order, and you may need to set your browser to accept both (functional) cookies and pop-ups to be able to use all the functionalities, which includes adding & amending items to your shopping bag and submitting your order. 

 

When you submit an order, we will send you an email acknowledging receipt of your order.  Our acceptance of the order takes place when the Products are shipped to you - we will send you an email confirming that the Products have been shipped (“Order Confirmation”). At this point, a contract containing the Terms & Conditions mentioned in this document comes into existence and is binding on you and us (the “Contract”). We recommend that you print or download a copy of these Terms of Sale and the relevant Order Confirmation for future reference. If we are unable to supply you with a product, we will inform you of this in writing and will not process the order.

 

Fulfilment of all orders on the Website is subject to availability. We explicitly reserve the right not to accept your order for any reason. We also reserve the right to cancel a Contract by written notice to you in the following situations, without being liable for any damage or costs other than repayment of any amount received from you in relation to the Contract we cancelled:

  • The product is not available / in stock.

  • Your billing information is not correct or not verifiable.

  • Your order is flagged up by our security systems as an unusual order or an order susceptible to fraud. 

  • You are under an age that is permitted under applicable UK law to enter into an agreement with LOW-KEY.

  • You are a reseller.

  • There was an error in the price displayed

  • We could not deliver to the address provided by you.

 

d. Prices and Payment

 

All prices on the Website are in pound sterling and are inclusive of VAT. 

 

LOW-KEY reserves the right to change prices for Products displayed at any time and to correct pricing errors that may inadvertently occur. In the event of a pricing error, we will notify you of the error and allow you to either proceed with the transaction at the correct price or cancel your order at no cost to you. 

 

You must pay the order amount by either Visa, MasterCard, Visa Debit or PayPal at the time of submitting the order. Payments will be made through either WIX payments or PayPal.

 

WIX payments includes the following features of protection: PCI-compliant payment processing, Secure on-site and in-app checkout with HTTPS/TLS data encryption, Common fraud attack protection with WIX’s AI and rule-based risk system 3D Secure 2 authentication at checkout for EU card payments. Payments with PayPal will be on their secure PayPal system, which uses the SSL "Secure Socket Layer" protocol, so that all information is encrypted by software and no third parties have access to this information during the processing of your payment for the Products.


 

5. Liability

 

Notwithstanding any other provision in the Terms, nothing in these Terms:

 

  • Affects or limits your rights as a consumer under English law; or

  • Will exclude or limit our liability for death or personal injury resulting from our negligence.

 

The Website is provided on an 'as is' and 'as available' basis without any representation or endorsement made and we make no warranties, whether express or implied, in relation to it and its use. You acknowledge that we cannot guarantee and cannot be responsible for the security or privacy of the Website and any information provided by you. You must bear the risk associated with the use of the Internet.

 

Whilst we will try to ensure that material included on the Website is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for any errors or oversights or for the results obtained from the use of such information or for any technical problems you may experience with the Website. If we are informed of any inaccuracies in the material on the Website, we will attempt to correct this as soon as we reasonably can.

 

We disclaim all liabilities in connection with the following:

 

  • Incompatibility of the Website with any of your equipment, software, or telecommunications links.

  • Internet including the loss of data, any intrusion, virus, service disruption or other unintended issues

  • Technical problems including errors or interruptions of the Website; unsuitability, unreliability, or inaccuracy of the Website.

  • Failure of the Website to meet your requirements.

 

LOW-KEY reserves the right, in its absolute discretion, to take any of the following measures if you fail to make a payment in accordance with these Terms of Trade:

 

  • Withhold the supply of and dispose of the Products requested in the order

  • Refuse to deal further with you, and LOW-KEY will not be liable to you for any loss or damage directly or indirectly resulting from any such action.

 

You have sole responsibility for determining the suitability of the Products for the purposes for which you intend to use them.

 

You must follow any instructions LOW-KEY may give you in relation to the safe use or storage of the Products. LOW-KEY will not be responsible for any damage to the Products which is caused by your failure to follow these instructions.

 

a. Force Majeure

 

If LOW-KEY is delayed or hindered in or prevented from performing any of its obligations under any order by reason of any event or circumstance beyond its reasonable control, LOW-KEY will only be responsible for loss or damage you suffer that is a natural and foreseeable consequence of LOW-KEY breaching its obligations under these Terms of Trade.

 

To the full extent allowed by applicable law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (both of which terms includes, without limitation, pure economic loss, loss of profits, loss of business, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special, or punitive damages whatsoever that arise out of or are related to the Website.

 

There are certain responsibilities which LOW-KEY cannot exclude by law and nothing in these Terms of Trade limits any liability of LOW-KEY to you for death or personal injury resulting from negligence. Subject to the following "Warranty" clause, and to the fullest extent permitted by law, the liability of LOW-KEY for any loss or damage suffered by you because of LOW-KEY breaching its obligations under these Terms of Trade or other duty is limited to a refund or replacement of the relevant Products.

 

b. Warranty

 

As a consumer you have certain legal rights, including legal rights relating to any Products that are faulty or not as described. For further information about your legal rights, contact your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms of Trade will affect these legal rights.

 

If you receive a Product that is not of satisfactory quality, you can contact LOW-KEY for a replacement or, where this is not possible, for a refund.

 

Your right to cancel the purchase:

  • As a consumer, you have the right to return the Products, without any reason within 14 working days from the receipt of the Products.

  • If the return of the Products is not because of a product defect or an error committed by LOW-KEY, you will have to pay the shipping charges for the return of the Products.

  • If you exercise this right to return the Products, you will contact info@low-key.co.uk and return the Products ordered, in a state fit for their resale and in their original packaging.

  • LOW-KEY will refund you within 30 days from the exercise of your right to cancel the purchase.


 

6. Refunds and Returns

 

We offer a full refund if you’re not satisfied with our Products. You have to contact info@low-key.co.uk within 14 days of receiving the product to initiate the return.

 

Only Products purchased on the www.low-key.co.uk website can be returned to LOW-KEY for a refund or an exchange.

 

Should you make an error when ordering online, LOW-KEY will exchange your Product for the Product you intended to purchase. The returned item must be unopened and in its original saleable condition. You are responsible for the shipping and additional postage charges.

Should a Product be damaged while it is being shipped to you, LOW-KEY will provide you with a full refund or exchange. Return postage will be refunded in case of damaged, defective, or incorrectly sent Products and a refund will be issued through the method used for payment.

 

In all cases, original proof of purchase must be available to be provided if asked to be seen by LOW-KEY.

 

Please retain your postal receipt until you are certain your parcel has been safely received by LOW-KEY. We may need to see this if we fail to receive your package.

 

We will do our best to process returns within 10 working days of receipt and a refund will be issued through the method used for payment.


 

7. Terms on Returning Items for Reuse 

 

A LOW-KEY ‘reuse’ voucher entitles the user to purchase the same product(s) as their previous order at the specified discount rate. By proceeding with the ‘reuse’ method, you accept all the full terms mentioned above on this document as well as the conditions stated below:

 

  • LOW-KEY has the right to decline the voucher if items are not returned in a reusable condition (items mean both container(s) & box). 

  • The container(s) being refilled and returned to the user may not be the one at original purchase.

  • All re-used items will be fully cleaned & disinfected, and user accepts liability in the event of any reactions happening from the sanitising & disinfecting process.

 

The voucher cannot be exchanged or redeemed for cash or transferred to another form or owner. LOW-KEY ‘reuse’ vouchers are valid for 7 days from the date of receipt. After the expiry date, the voucher will be void. Each voucher is linked to a unique code to ensure its security and integrity.
